Effective Processes

Our staff has spent countless hours researching what debt collectors can and cannot do in their attempts to collect unsecured debts, and the boundaries put in place per the Fair Debt Collection Practices Act. That extensive research, training, and experience has allowed us to implement processes, in accordance with the FDCPA, to effectively and efficiently counteract debt collection call harassment and abuse.
Let’s face it, the verbiage and legal-based terminology used in the FDCPA can be overwhelming and confusing. We have found effective methods to translate the verbiage used in the FDCPA into layman’s terms to help insure understanding. Many consumers are unaware of the guidelines debt collectors are supposed to adhere to; therefore, making them susceptible to harassment and abusive collection tactics. Utilizing the education, tools, and instruction we arm them with will help counteract, alleviate, and often eliminate harassing collection calls (i.e. collection calls at the workplace). Due to our extremely effective processes, we have found that the majority of debt collection agencies (debt collectors) will respect the rights of the consumer and honor their request.

Legal Referral Program
We understand the probability of creditors taking legal action to recover delinquent debt and their right to do so (if applicable). However, we have found that unscrupulous debt collectors often use threats of legal action solely as a collection tactic; not having any real intent to execute. Due to not being a legal organization or able to provide legal advice, but still accommodate the needs of consumers who’s rights have been blatantly violated in this manner, we have set up a reputable nationwide referral system. This will allow the consumer the option to have contact with an attorney in their state experienced with the FDCPA to discuss and possibly pursue legal action typically on a contingency basis or through a class action lawsuit. Although, we cannot guarantee representation by the attorneys participating in our Legal Referral Program, we find this resource to be a valuable service to those consumers that choose to pursue this option.

Empowerment Guide
Not all consumers subjected to some form of collection harassment are enrolled in a debt relief program or faced with filing bankruptcy. Debt collection harassment comes in many forms and is not always directed at the actual debtor, but rather at an indirect or unauthorized third-party. Some may experience being falsely pursued for a debt they do not owe or may be receiving calls from a debt collector seeking payment for a relative’s debt. These are just a couple of examples of collection harassment faced by consumers not associated with the subject debt, but are in need of relief from abusive debt collectors. They may not know their rights or how to go about exercising the rights afforded to them by the FDCPA. That’s where Consumer Justice Group comes in! This subscription-based program offers consumers the opportunity to receive one-on-one consultations with our professional advocates and specialized support and services not available to the general consumer or by purchasing the Empowerment Guide alone. Federal Trade Commission (FTC)

The Federal Trade Commission is an independent agency of the United States Government. One of it’s many roles is to govern the federal law (FDCPA) that regulates debt collection and protects consumers against unfair business practices. While the FTC does not resolve individual consumer problems, complaints may initiate investigation, which can lead to law enforcement action.
Every complaint counts! Taking action, such as filing a complaint with the FTC, increases the chance of investigation and action being taken against the collection agency/collector in violation, and is just one simple proactive step consumers can take to help protect their rights and expose the abusive actions of unscrupulous debt collectors.

Fair Debt Collection Practices Act (FDCPA)

The Fair Debt Collection Practices Act outlines what debt collectors can and cannot do in their collection efforts. They must abide by the Act or else they are in violation. Generally, the FDCPA applies to third-party debt collectors such as collection agencies and collection law firms. The Act does NOT cover original creditors, but some state laws may and often mirror the FDCPA. Not all debts are covered by the FDCPA, such as business debt, taxes, child support and marital settlement obligations. Personal, family, and household debts are covered.

FDCPA Violations

Unfortunately, the collection industry is plagued with debt collectors that are either undertrained on the guidelines of fair debt collection or are just plain unscrupulous and only care about their commission; a major factor that contributes to aggressive collection efforts, deceitful tactics, and blatant violations of the FDCPA.

Filing a complaint with the FTC is one simple proactive step consumers can take to help expose an unscrupulous collector. Another option consumers have is to pursue legal recourse (within one year of the violation) through an experienced FDCPA attorney located in their state for gross violations of the FDCPA.

Consumer Justice Group is not and does not make any claims of being a legal organization nor do we offer legal advice; however, we are able to accommodate consumers that choose to exercise their rights in this format by offering them contact with an experienced FDCPA attorney in their state who has agreed to participate in our Legal Referral Program.

Note! Advocacy companies that do not have attorneys on staff to address violations of the FDCPA should not claim they can stop legal actions or provide legal representation directly, but rather state they utilize a separate independent legal source or referral system. The advocacy company is not in the position to make such bold decisions or make statements that may lead one to believe they have the expertise onsite for such matters. This would be left up to the discretion of the attorney or legal assistance the customer has been referred to. It is extremely important to have a clear understanding of how violations of the FDCPA are dealt with by the advocacy company, and question whether such matters are handled internally by an attorney on staff or outsourced.

The Truth of the Matter!

By law, creditors and collectors have the right to make collection calls to debtors to pursue payment of a delinquent debt. However, collectors do not have the right to be harassing or abusive.

Don’t be mislead by advocacy companies that claim they can stop ALL collection calls. It’s not the actual collection call that is the issue; it’s the harassment in connection with the call that needs to be addressed.

A Limited Power of Attorney does not mandate that collection calls stop, it simply provides a specific party the right to make contact on behalf of another; stating this document is anything other than a tool to communicate with a creditor/collector is misleading.

A standard Cease and Desist Letter would have to be sent to the creditor/collector requesting all communication in connection with the debt stop. However, we have found that addressing collection calls is this manner may be detrimental to the client and possibly trigger some form of legal action. The FDCPA has very strict guidelines to correctly address harassing collection calls; Consumer Justice Group’s processes are in accordance with those guidelines.
